Hi, I’m Jessica Hoff, the bankruptcy attorney. People often ask me, “What happens if I’m in the middle of a divorce, and I want to file for bankruptcy?”
It’s very important to contact a bankruptcy before you get a Final Decree, or a Final Order in your divorce case. The reason is that if you have a Final Decree that says you have to hold the other spouse harmless and pay a debt, then I can not wipe it out in a Chapter 7 [bankruptcy].
Often times it’s better to file a Chapter 7 prior to filing your divorce case, but please contact us to make sure that that is the best fit for you.
